PRIVACY NOTICE (INFORMATION OBLIGATIONS)

Protecting your personal data is particularly important to us. We process your personal data exclusively in accordance with applicable legal provisions, in particular the General Data Protection Regulation (GDPR) and the Austrian Telecommunications Act (TKG). This Privacy Notice informs you about the most important aspects of data processing in connection with our website and webshop.

CONTACTING US

If you contact us via a form on the website or by email, we will process the data you provide (e.g. name, contact details, message content) for the purpose of handling your enquiry and any follow-up questions. We store this data for six (6) months and do not disclose it to third parties without your consent, unless disclosure is necessary to handle your request.

Legal basis: Article 6(1)(b) GDPR (steps prior to entering into a contract) and/or Article 6(1)(f) GDPR (legitimate interest in handling enquiries), depending on the context.

DATA PROCESSING IN THE WEBSHOP / CONTRACT PROCESSING (SQUARESPACE COMMERCE)

Our website and webshop are operated using Squarespace. To facilitate the purchasing process and for subsequent contract processing, we process the data necessary for ordering, payment handling and fulfilment, in particular:

  • name, billing and shipping address

  • telephone number and email address

  • ordered items and purchase date

  • payment and transaction information (processed via payment service providers; we do not generally store full payment card details)

  • technical data required to operate the webshop (e.g. IP address, device and log data)

The data you provide is required for the performance of the contract or for implementing pre-contractual measures. Without this data, we cannot conclude a contract with you.

Recipients / disclosure: We do not transfer your data to third parties except where necessary to fulfil the contract and legal obligations, in particular:

  • shipping/transport providers (delivery address and contact details as required for delivery),

  • payment service providers (for processing payments),

  • our tax adviser (for fulfilment of our tax obligations), and

  • Squarespace, as our website and webshop service provider, acting as a service provider/processor for hosting and platform functions.

Storage periods:

  • If the purchasing process is aborted, stored data will be deleted unless retention is required for other purposes.

  • If a contract is concluded, we store contractual and business records until the expiry of statutory retention obligations under tax law (generally seven (7) years).

  • Data relating to name, address, purchased goods and purchase date may be stored until the expiry of the product liability period (ten (10) years).

Legal basis: Article 6(1)(b) GDPR (contract performance) and Article 6(1)(c) GDPR (legal obligation, e.g. retention duties).

COOKIES (SQUARESPACE COOKIE BANNER)

Our website uses cookies. Cookies are small text files that are stored on your device via your browser. They do not cause any damage.

We use cookies to make our website more user-friendly, to enable essential website functions, and—where you consent—to measure and improve performance and marketing effectiveness. Some cookies remain stored on your device until you delete them and allow us to recognise your browser on your next visit.

Depending on your cookie settings and the configuration of our website, third-party services (e.g. analytics, embedded content, marketing tools) may be used. Such services may receive technical information (including your IP address) and may process it for their own purposes in accordance with their privacy policies. Where required, this occurs only with your consent via the cookie banner.

NEWSLETTER

You may subscribe to our newsletter via our website. For this purpose, we require your email address and your declaration of consent to receive the newsletter.

After registration, you will receive a confirmation email containing a link to confirm your subscription (double opt-in).

You may cancel your newsletter subscription at any time. To unsubscribe, please use the unsubscribe link in the newsletter or email: news@silverfineart.com. We will then delete your data used for newsletter distribution.
