Information on the Exercise of the Right of Withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen (14) days without giving any reason, provided you are a consumer and you are entitled to a statutory right of withdrawal under the mandatory consumer protection laws applicable to your purchase (in particular for deliveries within the EU/EEA). This policy does not apply to business customers.

The withdrawal period is fourteen (14) calendar days from the day on which you, or a third party nominated by you who is not the carrier, have taken possession of the last item.

How to exercise the right of withdrawal

To exercise your right of withdrawal, you must notify us:

by means of a clear statement (for example, a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form set out below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notice of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen (14) days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earlier.

Return of goods

You shall send back the goods or hand them over to us without undue delay and in any event no later than fourteen (14) days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen (14) days has expired.

You shall bear the direct costs of returning the goods.

Diminished value

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Notes

Where possible, please keep the original packaging until you have decided whether to exercise your right of withdrawal (this helps to ensure safe return shipping). Your statutory rights remain unaffected.

No right of withdrawal for bespoke/custom-made items (in particular, framed works)

The right of withdrawal does not apply to contracts for the supply of goods that are not pre-made and for which an individual choice or decision by the consumer is decisive, or which are clearly personalised.

At SILVERFINEART, framed and/or mounted works are generally treated as bespoke/custom-made items, as the frame, mount/passe-partout, mounting and/or format are assembled and/or produced on an order-specific basis. Accordingly, no right of withdrawal applies to framed and/or mounted works.

Worldwide deliveries – applicable consumer rights

We sell worldwide. Whether and to what extent you, as a consumer, have a statutory right of withdrawal depends on the mandatory consumer protection laws of your country of habitual residence and/or the delivery country. Where mandatory provisions grant a right of withdrawal, we will apply those provisions accordingly.
