TERMS OF SERVICE / GENERAL TERMS & CONDITIONS (GTC)
Scope of Application
These General Terms & Conditions (GTC) apply to all orders and purchases placed by customers via the online shop of SILVERFINEART e.U. (hereinafter “SILVERFINEART”, “we”, “us”).
Any deviating terms and conditions of the customer shall not apply unless we expressly agree to them in writing.
Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
By submitting your order, you make a binding offer to purchase the goods in your shopping cart. A contract is concluded as soon as we accept the order by sending an order confirmation by email or by dispatching the goods.
We reserve the right to reject orders without stating reasons.
Prices and Payment Terms
All prices are stated in euros. Unless stated otherwise, prices include statutory VAT (if applicable) and exclude shipping costs.
Payments are processed via the payment methods offered at checkout. We reserve the right to exclude individual payment methods in specific cases.
Shipping and Delivery
Delivery is made to the shipping address you provide.
Delivery times are non-binding unless expressly agreed as binding. Delays may occur, in particular due to force majeure, customs clearance, transport difficulties, or supply shortages.
If delivery cannot be completed for reasons attributable to you (e.g., incorrect address, refusal to accept), additional costs (e.g., return shipping, re-shipping) may be incurred.
Retention of Title
The goods remain our property until full payment has been received.
Digital Content and Communication
If you provide your email address in the course of an order or enquiry, we use it to communicate about the order (e.g., order confirmation, shipping confirmation, queries).
You will receive marketing emails (newsletter) only if you have subscribed or if the legal requirements are met. You can unsubscribe at any time.
Warranty and Defects
The statutory warranty rights apply.
Please inspect the goods upon receipt and, if possible, report any obvious transport damage promptly to the delivery service and to us. Your statutory rights remain unaffected.
Liability
We are liable without limitation for damages caused by intent or gross negligence, as well as for injury to life, body, or health.
In cases of slight negligence, we are liable only for breach of essential contractual obligations (cardinal obligations), limited to the typically foreseeable damage.
Any further liability is excluded to the extent permitted by law. Mandatory statutory liability (e.g., under product liability law) remains unaffected.
Force Majeure
Events beyond our control (e.g., natural disasters, strikes, official measures, war, pandemics, supply chain disruptions) may temporarily make performance wholly or partially impossible. In such cases, delivery and performance deadlines shall be extended accordingly.
Amendments to the GTC
We may adapt these GTC if objectively required (e.g., changes in law, technical development of the shop). For contracts already concluded, the version valid at the time of the order shall apply.Governing Law, Jurisdiction, Contract Language
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
If you are an entrepreneur, the place of jurisdiction is Vienna.

If you are a consumer and you generally have a right of withdrawal, the following applies: The right of withdrawal does not exist for contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or specification by you is decisive, or which are clearly tailored to your personal needs.
This includes in particular custom-made items such as: special formats, bespoke framing, specific material or finish requests, personalized works, and commissioned works.
We will inform you about the custom-made nature before production begins. Execution begins upon your approval/confirmation.Notes on Colour and Display Deviations
The display of artworks, prints, frames, and materials may vary depending on screen/device, colour profile, brightness, and calibration. Differences in colour, contrast, and detail between the digital display and the actual product are therefore possible and do not constitute a defect, insofar as they are customary and reasonable.
For unique pieces, material- and work-specific characteristics (e.g., texture, patina, slight irregularities) may occur; these are part of the artistic execution.Shipping, Insurance, and Transport Risk for Artworks
We pack artworks and goods professionally and—where offered or agreed—insured for transport.
For consumers: The risk of accidental loss and accidental deterioration passes only upon handover of the goods to you or a person authorized by you to receive them.
For entrepreneurs: The risk passes upon handover of the goods to the transport company (shipping service provider).
If possible, please inspect the shipment upon delivery. If external damage to packaging or goods is visible, have this confirmed by the delivery service and inform us immediately. Your statutory rights remain unaffected; however, reporting facilitates processing.
For particularly valuable or sensitive artworks, we may—depending on destination and value—offer or require special shipping methods (e.g., fine art logistics, special packaging, additional insurance). Any additional costs will be communicated transparently in advance.Deliveries Outside the EU – Customs, Import VAT, and Import Duties
For deliveries outside the European Union, customs duties, import VAT, handling fees, or other import charges may apply. These costs are generally charged by the authorities in the destination country and/or the shipping service provider and—unless expressly agreed otherwise—must be borne by you.
We have no influence on the amount, collection, or timing of such charges. Please inform yourself about the applicable regulations in the destination country before placing an order.Care, Handling, and Hanging of Artworks
Artworks and high-quality prints are sensitive products. Please observe the following:
Light & climate: Avoid direct sunlight as well as extreme temperature fluctuations and high humidity (e.g., directly above radiators, in bathrooms without adequate ventilation).
Handling: Avoid touching print surfaces, glass, or sensitive areas with bare hands; use clean gloves or hold the work by the edge or frame.
Cleaning: Do not use aggressive cleaning agents. For glass, apply suitable glass cleaner to a cloth (do not spray directly onto the work). Clean surfaces depending on the type of work only dry or with a very soft cloth.
Mounting/hanging: Use suitable wall plugs/screws/rail systems according to wall condition and weight. For heavy or particularly valuable works, we recommend professional installation.
Improper treatment: Damage caused by improper storage, care, installation, or external influences is not covered by warranty.
